Subclass 186 – Employer Nomination Scheme Visa (ENS) |
This visa allows the skilled worker, nominated by the employer, to live, and work in Australia permanently. |
There are 3 streams available to apply:
- Direct Entry stream
- Labour Agreement stream
- Temporary Residence Transition stream – the pathway from subclasses 482 or 457 visa, after they have worked for the employer for 2/3 years

In the Direct Entry stream the applicant can:
stay indefinitely
work and study
enroll in the public health scheme Medicare
sponsor eligible relatives to come to Australia
travel to and from Australia for 5 years
become an Australian citizen if eligible

The application must
have an eligible occupation on the Medium and Long-term Skills Occupation List (MLTSSL).
be nominated by an Australian approved employer
be employed in a full-time position which is available for a minimum of 2 years
at least 3 years of relevant work experience
must be licenced, registered or a member of a professional body
have a positive skill assessment
have a Competent English
be under 45 years old, unless exempt
meet the health, character, no debts, refused or cancelled visas requirements

In the Labour Agreement stream, the applicaion can
work under a labour agreement
must be licenced, registered or a member of a professional body
be nominated by an Australian employer
a holder of substantive 457 or TSS visa issued under a labour agreement
have a Functional English
be under 45 years old
meet the health, character, no debts, refused or cancelled visas requirements

In the Temporary Residence Transition stream the applicaion must
have an eligible occupation on the Medium and Long-term Skills Occupation List (MLTSSL).
have the required skills and qualifications to perform the nominated occupation.
be nominated by an Australian employer who sponsored for a temporary work visa.
must be licenced, registered or a member of a professional body.
a holder of subclass 457 or subclass 482 visa for at least 3 of the 4 years prior nomination for 186 visa or a Bridging visa A, B, C.
have a Competent English.
be under 45 years old, unless exempt.

Subclass 187 – Regional Sponsored Migration Scheme Visa (RSMS)
This visa allows the skilled worker, nominated by the employer in regional Australia, to live and work in Australia permanently.
The Department does not accept the new applications for the subclass 187 visas under the Direct Entry stream, the only the holders of the subclasses 457 or 482 can apply under the Temporary Residence Transaction stream.

At this moment, the available stream to apply is the Temporary Residence Transition stream where the applicant can:
stay indefinitely
work and study
enroll in the public health scheme Medicare
sponsor eligible relatives to come to Australia
travel to and from Australia for 5 years
become an Australian citizen if eligible

The application must:
have the required skills and qualifications to perform the nominated occupation
must be licenced,
registered or a member of a professional body
be nominated by the employer who sponsored your temporary work visa
be under 45 years old unless exempt
a holder of subclass 457 or subclass 482 visa or a Bridging visa A, B, C

Subclass 482 – Temporary Skilled Shortage Visa (TSS)
This temporary visa allows an employer to sponsor a qualified worker to fill a position for which they cannot find a suitably qualified Australian.
The applicants may have a minimum standard of English proficiency and no age restrictions.
There are 3 streams available for the applicants:
- Short-term stream
- Medium-term stream
- Labour agreement stream

In the Short-term the applicant can:

The applicant must:
be nominated by an approved sponsor in an occupation listed on the Short-Term Occupation List (STSOL)

be a holder of a substantive visa or Bridging visa A, B, C
have relevant skills, qualification
at least 2 years of relevant experience
have a positive mandatory skill assessment
have not violated the legal provisions for payment of visa sponsorship
must have a genuine intention to stay in Australia temporary
must keep adequate health cover

In the Medium-term stream the applicant can:
work for up to 4 years for your sponsor, up to 5 years for Hong Kong visa holders
study without government assistance
travel to and from Australia during the visa validity
apply for permanent residence, if eligible

The applicant must:
be nominated by an approved sponsor in an occupation listed on the Medium-Term Occupation List (MLTSSL)
be a holder of a substantive visa or Bridging visa A, B, C
have complied with the previous visa conditions
be nominated by the approved sponsor
work for your nominated employer
have relevant skills, qualification
at least 2 years of relevant experience
have a positive mandatory skill assessment

In the Labour agreement stream the applicant can:
work for up to 4 years for your sponsor or up to 5 years for Hong Kong passport holders
study without government assistance
travel to and from Australia during the visa validity

The applicant must:
be nominated to work in a specified occupation under the terms of a Labour Agreement
have at least 2 years of relevant experience
must be nominated
|
Subclass 494 – Skilled Employer-Sponsored Regional (Provisional) Visa
This visa allows regional employers to sponsor qualified workers from overseas if they cannot find a suitably qualified Australian worker.
The applicants for the Employer Sponsored and Labour agreement streams:
live, work and study in designated regional areas for 5 years
travel to and from Australia during the visa validity
apply for permanent residency after 3 years of visa grant

In the Employer-sponsored stream, the applicant must:
be nominated by an approved sponsor from the designated regional areas
have relevant skills, qualifications, and work experience for the nominated position
have a positive mandatory skill assessment
have a Competent English
be under the age of 45 years old

In the Labour agreement stream the applicant must:
be working under a labour agreement between the Government and the nominator
have relevant skills, qualifications, and experience in the nominated occupation
have a positive mandatory skill assessment
have a level of English specified in the labour agreement
